Different roles but necessary agencies in Canada’s financial fraud prevention

A useful breakdown and comparison can be found here in this LinkedIn post of two key
agencies in Canada with respect to financial fraud prevention. Both are critically important
to Canadian financial institutions understanding their distinguishing role and how they
need to comply with their respective obligations under them.

The question to pose here is the federal government and these federal regulatory agencies
– FINTRAC and OSFI, doing their job to hold financial institutions accountable in preventing
money laundering and protecting consumers from losing money to proceeds of crime?

🇨🇦 FINTRAC vs OSFI:
Understanding Canada’s Dual Regulatory Framework.

Canada’s financial system is built on a strong regulatory framework where OSFI and FINTRAC have distinct but complementary responsibilities.

While they often work alongside the same financial institutions, their mandates are very different:

🏦 OSFI (Office of the Superintendent of Financial Institutions) safeguards the safety and soundness of federally regulated financial institutions through prudential supervision, governance expectations, capital adequacy, liquidity oversight, and operational resilience.

🛡️ FINTRAC (Financial Transactions and Reports Analysis Centre of Canada) is Canada’s financial intelligence unit responsible for administering and enforcing the PCMLTFA, receiving and analyzing financial reports, promoting AML/CFT compliance, and producing financial intelligence to help combat money laundering, terrorist financing, and threats to Canada’s security.

Financial institutions play a central role by complying with both regulatory frameworks through:
• Know Your Client (KYC)
• Transaction Monitoring
• Sanctions Screening
• Record Keeping
• STR Reporting
• Enterprise Risk Management

Understanding the distinction between prudential regulation and AML/CFT regulation is fundamental for professionals working in banking, financial crime, treasury, payments, and compliance.

Which Canadian regulator do you interact with most in your role—OSFI, FINTRAC, or both?
